General terms and conditions (GTCs)

General

This online shop is operated by CALEO Cashmere. Owner of the sole proprietorship and operator of the online shop is Elisabeth Bauer. Contact details:  Mobile: +43/664/1203667, email: ebauer@caleo.co, homepage: www.caleo.co. Business premises:  Scharnsteinerstraße 23, 4810 Gmunden, Austria.

This sole proprietorship is registered as free commercial enterprise and member of the Austrian Federal Economic Chamber (WKÖ) and Federal Economic Chamber of Upper Austria (WKOÖ). The trade or professional regulations of the Austrian Industrial Code (the Austrian Federation’s legal information system) apply: www.ris.bka.gv.at). Place of jurisdiction: Gmunden district authority.

The line of business is textile trade (fashion).

Order process/contract conclusion

A customer’s order represents an offer. A contract is only valid after acceptance on our part. The customer will be informed of our acceptance by email.

An order is only possible if all fields marked with * in the order form are filled out. If information is missing or if we are unable to fulfil the order for other reasons, the customer will receive an error message. The customer is given the opportunity to correct his/her order before the final dispatch of the order. The customer receives supporting detailed information directly during the ordering process.

As soon as the order process is completed, the customer is informed by an information window ‘Your order has been confirmed.  A confirmation has been sent to you’. This does not yet represent an acceptance of the customer’s offer on our part.

When the order has arrived at CALEO, the customer will receive an order confirmation to the email address he/she has provided. The order confirmation already represents a concluded contract. We do not store this document. If the customer wishes to cancel the order confirmation, he/she must save it or print it out himself/herself.

The contract languages are German and English.

Unless otherwise agreed, we will delivery within 3-5 working days after sending the order confirmation. It is possible to change the order until receipt of the shipping confirmation.

Payment

All prices are total prices. They include all taxes and charges. Shipping costs will be charged separately (see below).

We accept the following payment methods: Credit card, instant payment.

The goods shall remain our property until complete payment has been made.

Warranty and guarantee

The warranty period begins on the day of delivery. The provisions on the statutory warranty shall apply. The warranty period for the delivery of movable goods is 2 years from acceptance of the goods. Complaints due to legal warranty claims or other complaints can be asserted using the contact details specified in the imprint. We do not grant our own guarantees beyond the statutory warranty. The warranty takes place with the customer. We bear the shipping costs for the exchange of defective goods.

We expressly point out that the colours of the items may differ from the photos shown in the online shop. This is usually because the display of the colours depends on the screen of the output device. In addition, original colours on photos cannot always be reproduced true to the original.

Right of revocation (= right to withdraw)

You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party designated by you, other than the carrier, has taken possession of the goods. The returns shall be borne by the customer.

To exercise your right of revocation, you must inform us – CALEO Cashmere, Elisabeth Bauer, Scharnsteinerstraße 23, 4810 Gmunden, Austria, mobile: +43/664/1203667, email: ebauer@caleo.co– by means of a clear declaration (e.g. a letter sent by post, fax or email) regarding your decision to revoke this contract. You can use the attached sample revocation form; however, this is not compulsory.

To comply with the revocation period, it is sufficient that you submit the notice of the right to revocation before expiration of the revocation period.

Consequences of revocation

If you revoke this contract, we shall refund all payments that we have received from you, including delivery costs (with the exception of additional costs that arise should you have chosen a type of delivery other than the reasonable, standard delivery that was offered by us), immediately and at the latest, fourteen days from the day that notice of your revocation has been received by us. To make refunds, we use the same payment method that you used for the original transaction, unless something different was explicitly agreed with you; on no account shall fees be charged as a result of this refund.

We can refuse the refund until we have received the goods or until you have produced proof that you have sent the goods back, depending on which is earlier.

You must immediately and in every case return or handover the goods to me within fourteen days from the day that you inform me of the revocation of this contract – CALEO Cashmere, Elisabeth Bauer, Scharnsteinerstraße 23, 4810 Gmunden, Austria. You shall bear all costs for returning the goods.

You must only pay for a possible loss in goods value resulting from handling them in a way other than what is necessary to ascertain the nature, characteristics and functions of the goods. Sample revocation form: see annex.

Complaints/claims

Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury or damage to objects taken over for processing as well as any product liability claims.

Data privacy

 We would like to point out that the customer’s IP information is stored within the framework of cookies for the purpose of simplifying the purchasing process and for subsequent contract processing by the online shop operator, as is the name, address, email address and credit card number of the purchaser. The data will not be transmitted to third parties, with the exception of the transmission of the credit card number to Oberbank Gmunden bank for the purpose of debiting the purchase price.

Once the virtual purchase is completed or the purchase process is terminated, the data stored in the cookies is deleted.

Newsletter

If the customer has ticked this at the end of his order, he/she has thereby agreed to receive news from my company about my products, current offers and other company-related information, such as future sales events and pop-up events via advertising emails, in particular newsletters. The customer hereby agrees that the following personal data – name, address, email address (telephone number, if desired) will be stored for this purpose. Any consent given once can be revoked at any time, which makes the further use of the data inadmissible. The customer can revoke his/her consent to receive these kind of emails at any time as follows: by sending an email to the following email address – ebauer@caleo.co– with the message ‘no more advertising emails please’.
